Ademola Adeleke

Osun State High Court sitting in Osogbo has dismissed a suit challenging the eligibility of Senator Ademola Adeleke as the candidate of the Peoples Democratic Party (PDP) in the September 22 governorship election.

The presiding judge, Justice David Oladimeji, in his ruling yesterday, punctured the allegation of certificate forgery raised by the plaintiffs.

Two PDP members, Rasheed Olabayo and Oluwaseun Idowu, had approached the court alleging that Senator Adeleke was not qualified to contest the election. They prayed the court to stop the PDP from presenting him to the Independent National Electoral Commission (INEC) as its candidate for the Osun governorship ballot.

The plaintiffs also urged the court to restrain INEC from accepting Adeleke as candidate on the basis that he was not qualified for the PDP primaries.

They cited Section 177 (d) of the 1999 Constitution to buttress their claim.

In his judgement, the judge contended that the plaintiffs’ claims that Adeleke does not possess school certificate could not disqualify him from contesting the election, as the constitution does not stipulate that a candidate for the office of the governor must possess a certificate.

He, however, said the constitution only expected the candidate to be educated up to secondary school level.
